SCAQMD Commercial NOx Rule Upheld in 2-1 Decision in Ninth Circuit

On Thursday, July 2nd, the U.S. Court of Appeals for the Ninth Circuit upheld the South Coast Air Quality Management District’s (SCAQMD) rule requiring certain gas-fired appliances to meet zero nitrogen oxide (NOx) emissions standards. The decision allows the regional air quality district to continue implementing regulations that phase in restrictions on the manufacture, sale, and installation of gas commercial water heaters, small commercial boilers, and process heaters across portions of Los Angeles, Orange, Riverside, and San Bernardino counties.
