Oregon EPR Lawsuit Upheld by Judge

On Thursday, August 27th, 2026, Judge Michael Simon of the U.S. District Court for the District of Oregon upheld Oregon’s Plastic Pollution and Recycling Modernization Act challenged by the National Association of Wholesalers-Distributors (NAW). The Act implemented the extended producer responsibility (EPR) program for packaging materials. NAW shared that they “strongly disagree” with the court’s ruling and were disappointed with the outcome. NAW also shared that they were preparing for such an outcome and will review its options for next steps.
