New York DEC Delays Remote Condensing Unit and VRF Prohibition Dates

August 6, 2026 | 3 minute read

The New York Department of Environmental Conservation (NYSDEC) has filed an enforcement discretion letter to create a delay in the prohibition dates for VRF and remote condensing unit sales and installations. Previously, in effect January 1, 2026, then delayed with variances, and now the newest delay aligns the VRF system refrigerant prohibition with the EPA Technology Transition rule. As for remote condensing units in New York, the prohibition on the use of low-GWP refrigerants is delayed until January 1, 2028.
